TERMS AND CONDITIONS OF USE OF THE WEBSITE “domashop.mx”

(HEREINAFTER THE “STORE” OR THE “SITE”) EFFECTIVE AS OF MAY 18, 2019.

PRELIMINARY CONSIDERATIONS

This document sets forth the general terms and conditions applicable to the use of the services offered by TABIQUE Y MORTERO S. DE RL DE CV (hereinafter, the "Company") on the domashop.mx site (the "Store"). Any person who accesses and/or uses domashop.mx (the "User") agrees to comply with these terms and all related policies.

ANY PERSON WHO DOES NOT ACCEPT THESE GENERAL TERMS AND CONDITIONS, WHICH ARE MANDATORY AND BINDING, MUST REFRAIN FROM USING domashop.mx AND/OR THE SERVICES.

The User must read, understand and accept all the conditions established in the general terms and conditions and in the Privacy Notice as well as in the other documents incorporated therein by reference, prior to registering as a User on domashop.mx.

CLAUSES

FIRST.- ACCEPTANCE OF LEGAL TERMS.
In order to offer a safe and pleasant environment for our Users, we have established rules and terms under which the areas of responsibility and rights of both domashop.mx and our users are delimited.

By visiting domashop.mx, the User is subject to the guidelines, rights and restrictions mentioned herein. domashop.mx reserves the right to modify this document at any time and under the circumstances that best suit it, with these changes being effective at the time of publication.

SECOND.- REGISTRATIONS, ACCOUNTS, PASSWORDS AND SECURITY.
domashop.mx will use the information provided by the User confidentially, and therefore may not distribute or transmit it to other providers outside the transaction, except with the express authorization of the User or at the request of a competent authority.

Use of domashop.mx may require the User to open an account and set a password. The User is entirely responsible for maintaining the confidentiality of his/her account information, including his/her password, for any and all activity that occurs under his/her account. The User agrees to notify domashop.mx immediately of any unauthorized use of his/her account or password, or any other risk to the security of his/her account.

The data entered by the User must be completely true. If it is incorrect or false, domashop.mx reserves the right to delete the account registered with that data and prohibit the registration of said person identified by email, name or any other information that domashop.mx considers appropriate.

THIRD.- PAYMENT METHODS.
Directly on our portal through Paypal or Grupo Conektame SA de CV (Conekta) with Visa, Mastercard or American Express credit cards or debit cards from most Mexican banks or referenced payment in Oxxo or via SPEI or whatever the payment agreement between both parties.

FOURTH.- PAYMENT AND MERCHANDISE POLICIES.
domashop.mx reserves the right to request official documents from its customers as a means of validating the process of acquiring products through its website.

The order number assigned when making a transaction on the domashop.mx website does not imply acceptance of the transaction. In the event of any problem with the User's order, domashop.mx will notify the User of this situation by email or telephone.

Notifications of your purchase, shipping, delivery and others will be made via email or through the website domashop.mx.

FIFTH.- AVAILABILITY OF MERCHANDISE AND STOCK.
If the delivery time offered is not entirely satisfactory to the User, the latter may request cancellation of the order within a period of no more than 5 business days. All products offered on domashop.mx are subject to availability.

All merchandise from domashop.mx is subject to stock, so delivery time may vary upon prior notice from the latter, or even the order may be cancelled and payment refunded if the product is not resalable.

SIXTH.- PRICES.
Prices published on the domashop.mx website may change without prior notice. If for any reason the price is $0.00 or $0.01 or any other clearly incorrect price, the User must contact falvarez+domashop@domadesign.mx via email in order to request the correct price of the desired item.

SEVENTH.- PRODUCT SPECIFICATIONS.
Product features and specifications are subject to change without notice. The photographs may or may not correspond specifically to these and are of a similar product represented for illustrative purposes only.

EIGHTH.- SHIPMENT OF PRODUCTS.
Delivery time starts at most 48 (forty-eight) hours after payment confirmation.

The products will be sent by private parcel or courier to the User's address and/or an office of said parcel or courier. The delivery time will depend on the availability of the purchased products and the land transport service company. Once payment has been confirmed and accepted, the User accepts that domashop.mx may delay delivery indefinitely if the product is out of stock or if an event occurs that prevents delivery on the selected days.

NINTH.- PACKAGING.
All merchandise will be shipped with the factory packaging of the purchased product.

TENTH.- CANCELLATIONS.
Order cancellation only applies before domashop.mx confirms the shipment of the order. Once the order is cancelled, a refund process will begin, during which the User must send the bank details to which the refund must be made, including:

name of the bank
name of the holder
account number
Account CLABE (18 digits)

The refund will be made specifically through the same means or method of payment that the user used to make the corresponding purchase.

ELEVENTH.- DATA PROTECTION.
The data provided by the User will be protected in accordance with our Privacy Notice, published on domashop.mx.

TWELFTH.- PRODUCT WARRANTY.
The guarantee of the products will be provided directly by the manufacturers or distributors of the same, the duration of said guarantees is clearly referred to in the description of each product and is issued and validated by the manufacturer or distributor of each product, therefore domashop.mx, does not assume any responsibility regarding said guarantees and the subscriber is obliged to directly contact the supplier or manufacturer of the products in question to make said guarantee effective.

domashop.mx will not be responsible for the guarantees granted by the manufacturers or distributors of the products, but will take all actions tending to provide subscribers who so request the contact information for said service.

THIRTEENTH.- BILLING.
In the event that the User requires an invoice for the total amount of their purchases and does not request it when entering domashop.mx, they may request it by emailing facturacion@domadesign.mx , sending for such purposes the following:

number of your order
name or company name
RFC
full tax address

The data must be sent within the current month and year, at least 5 days before the end of the current calendar month.

Invoices cannot be issued for purchases made outside the current month.

FOURTEENTH.- RETURN POLICY.
The User may request the exchange of their products or the refund of their payment when the products in question are not in the conditions described and this is done within the first 3 (three) days of having received their order.

FIFTEENTH.- APPLICABLE LAW AND JURISDICTION.
For the interpretation and compliance of these terms and conditions, the parties submit to the jurisdiction of the courts of Mexico City, expressly waiving any other jurisdiction that may correspond to them by reason of their present or future addresses.

SIXTEENTH.- NOTIFICATIONS

The address of TABIQUE Y MORTERO S. DE RL DE CV is located at Av. Vasconcelos Ote. # 617 Col. Valle de Santa Engracia, San Pedro Garza García, NLCP 66268 .

Notifications will be valid at the email address administracion@domadesign.mx and will be presumed to have been received no later than five business days after being sent.
